Street Victims Protection Fund as Information Centre acts in the interest of the injured parties as a result of motor vehicle accidents as it is stipulated in chapter 3 of “FPVS’s prerogatives as Information Centre” as part of “ Norms of FPVS” put into force by the Order no. 1/2008 of the President of the Insurance Supervisory Commission
General Conditions of Intervention:
• The Fund shall provide information to the injured natural and legal persons or residents in Romania in the following situations:
a) if the accident took place in the territory of a state whose National Bureau is a member of the Green Card System, other than Romania and the accident was caused by a vehicle from the EEA.
b) if the accident took place in Romania
The necessary data
• The injured natural or legal persons and the residents in Romania or the Information Centers from EEA states and Switzerland are entitled to ask for information and FPVS shall provide the following information
- the name and address of the insurance undertaking
- the name and address of the insurance undertaking’s claims representatives in Romania of the guilty party
- the number of the insurance policy
- the name and address of the body designated to compensate the injured parties in Romania if the vehicle is exempted from the compulsory motor third party liability insurance cover
• The Fund shall provide the injured party with the name and address of the owner or the driver or the registered keeper of the vehicle only if the injured party has a legitimate interest in obtaining this information.
The necessary data for obtaining information:
- registration plate number of the vehicle
- any other information which could lead to the identification of the state where the vehicle is normally based
- date and place of the accident
- residence state of the injured party
The request for this information can be done in Romanian, English, French or German and can be sent by mail, fax or e-mail and also by phone.
FPVS is not responsible for incomplete or incorrect information obtained from other sources, entities or bodies
If the Fund has direct access to the requested information, it shall be immediately provided. If not, the Fund shall inform the claimant in 14 days since he presented his request. The Fund shall begin an investigation whose results will be communicated as soon as they are obtained.
The information shall be communicated by phone or sent by fax, e-mail or mail in Romanian, English, French or German. |
