Regulations of the Institution

Street Victims Protection Fund as Guarantee Fund acts in the interest of the injured parties as a result of motor vehicle accidents as it is stipulated in chapter 2 of “FPVS’s prerogatives as Guarantee Fund” as part of  “ Norms of FPVS” put into force by the Order no. 1/2008 of the President of the Insurance Supervisory Commission
General Conditions of Intervention

  • The Fund guarantees, according to the law, the compensation of the persons who suffered losses after being involved in accidents caused by unidentified or uninsured vehicles and shall compensate these persons if the liable persons do not compensate for the damages they caused. It is not necessary for the injured party to prove that they have undertaken measures to recover their losses.
  • If the accident was caused by an uninsured vehicle which was under the obligation of having a compulsory motor third party liability insurance, the Guarantee Fund guarantees and compensates for property damages and bodily injuries.
  • If the accident was caused by an unidentified vehicle which must have a compulsory motor third party  liability insurance, the Guarantee Fund shall compensate only for bodily injuries. The Guarantee  Fund shall compensate the injured party also for property damages caused by an unidentified vehicle only if at least one person suffered in the same accident severe bodily injuries which needed more than 60 days of medical care; in this case the Fund shall compensate the material damages only in excess of 500 euros. An accident caused by an unidentified vehicle means that there was a direct collision with the injured party or with the damaged goods after which the guilty party left the site of the accident
  • the right to be the beneficiary of a compensation, as well as the amount of it after being involved in accidents caused by vehicles which do not have a compulsory motor third party liability insurance or unidentified ones, shall be established only according to the legal provisions in force depending on the date and place of the accident
  • the persons who can be compensated are those who are stipulated in the legislation in force at the date of the accident


In case of damages caused by an unidentified or uninsured vehicle you should send the claim notification along with every document necessary to support your claim. You will send at least  the Police Report or the European Accident Report/Constat Amiable D’accident Automobile to the:

The claim notification and the documents must be in originals, but at first they can be sent by fax no. 004 021 3123182 or by e-mail office@fpvs.ro. You must also communicate your full address, phone no, mobile phone no, fax no or e-mail. In case you are needed to send other documents, you will be notified about this. You will also have to follow the instructions  for the technical assessment and the evaluation of the damages.
You will receive the proper compensation or at least a reasoned reply in 90 days since you presented your claim.
